Daddy Lumba saga: Akosua Serwaah appeals High Court ruling
One of the two women declared by the High Court as co-widows of music icon, Daddy Lumba, has appealed the High Court’s decision.
Akosua Serwaah, known to have been married to the musician first, avers that the court erred in declaring both herself and Priscilla Ofori, aka Odo Broni, as the lawful surviving spouses of the late music icon, born Charles Kwadwo Fosu.
In a notice of appeal filed at the Court of Appeal in Kumasi, Akosua Serwaah is challenging the entire judgment of the High Court, arguing that the court erred when it rejected and declared as inadmissible a marriage certificate she tendered into evidence.
Again, she avers that the High Court committed an error of law when it held that she failed to meet a condition under the Evidence Act, 1975 (NRCD 323), in order for the marriage certificate to be admitted into evidence.
The appellant is, therefore, praying the Court of Appeal to set aside the judgment of the High Court and hold her as the only lawful surviving spouse of Daddy Lumba.
Judgment
On November 28, 2025, the Kumasi High Court, presided over by Dr Dorinda Smith Arthur, dismissed a suit by Akosua Serwaah, who was seeking to be declared by the court as the only surviving spouse of Daddy Lumba.
According to the court, the plaintiff failed to prove that she was married to the late musician under the ordinance to make her the sole surviving spouse.
The court held that per the evidence on record, Daddy Lumba married Akosuah Serwaah under customary law, and since marriage under customary law was potentially polygamous, the second marriage to Odo Broni was also valid.
In totality, the court declared both Akosuah Serwaah and Odo Broni as legally recognised surviving spouses of the music legend.
