The accused was convicted on his own plea.

Presenting the facts to the court, ASP Richmond Akwasi Yeboah, the prosecutor, said on February 12, 2016 at about 12:30 a.m., the complainant, Ms Herty Asamoah Quampeh went to bed but left her doors opened due to intensive heat.

He said Akoto took advantage of that, sneaked into the room and stole Herty’s mobile phone valued at GH¢400.

ASP Yeboah said while Akoto was in the act, Herty suddenly woke up and informed one Obed Odei who is a witness in the case and described the outfit of the convict.

ASP Yeboah said later, Akoto was confronted but he became offended and engaged the complainant and the witness in a fight.

He said afterwards Akoto reported to the police that he had been assaulted by Herty.

The prosecution continued that Akoto’s family also threatened to invoke their ancestral spirits on Herty since they believed strongly that Akoto did not commit that crime.

ASP Yeboah said the following day, Akoto, who looked so frightened, went to his friend with the said phone and confessed to him that he really stole the phone.

Armed with that information, the friend went to Herty and pleaded on Akoto’s behalf for her to temper justice with mercy.

Based on that, Herty informed the police and on February 15, 2016 at about 3:00 p.m., Akoto was arrested at Atimpoku and sent to the Frankadua police station.
