High Court judge launches book on civil procedure

A book that gives insightful and comprehensive information on the rules, technicalities, and emerging issues on civil procedure and litigation has been launched in Accra.

Titled “Contemporary and Evolving Issues in Civil Procedure and Litigation”, the book delves into the rules and procedures in litigation, as well as their practicability and application in the courtroom. 

The 21-chapter book was authored by a Justice of the High Court, Justice Alexander Osei Tutu, while the Chief Justice, Justice Gertrude Sackey Torkornoo, wrote the foreword and also suggested the title of the book. 

The book further provides a historical perspective on the development of legal principles in different common law jurisdictions, revealing their jurisprudential differences and how best the rules of procedure could be enhanced to improve justice delivery. 

Some topics in the book include “Revisiting Procedure: Doing it Right!”, “Rules on Default Judgment in Declaratory and Related Reliefs: A Pitfall for the Unwary?”, and “Capacity Acquired During Proceedings: and “Is Akrong vs Bulley still Good Law?”

The book launch, held at the Law Court Complex in Accra, attracted many notable judges and lawyers in the legal fraternity, including the Chief Justice.

Book 

Justice Osei Tutu explained that the book was written in a beautiful, humorous style, making it an easy read for both legal professionals and the public. 

“The book is for everyone. It is an easy read because it is not written in the legalistic complex language but in a beautiful humorous style”, he stated.

He said the 500-page book could be handy and helpful for all spheres of society, including activists seeking to challenge gender activists and those interested in the challenges of parallel proceedings and representation, as well as the impact of COVID-19 on legal systems and data management.

The controversial penalty awarded against Ghana in the first group game with Portugal at the 2022 FIFA World Cup is featured in Chapter 10 of the book, with Justice Osei Tutu using it to illustrate how the book's journey would be far from boring for readers.

He explained that the book was not intended to be just an ordinary text but rather a "nuclear operator" to generate fruitful debates and discussions for the development of Ghana's legal landscape.

Commendation 

The Chief Justice commended Justice Osei Tutu for authoring a book that would help enrich law literature.

She said the topics covered in the book were pertinent issues confronting the courts daily, particularly in the application of procedural rules and the resolution of substantive rights.

“It is the law that shapes what we eat, what we drink, what we wear and how we work”, she stated. 

Justice Torkornoo stressed the dynamic process of finding new ways to make access to justice easier and less complicated, intending to boost citizen and investor confidence in the administration of justice.

“We are constantly in search of effective ways of avoiding delays and making litigation less costly with a view to boosting citizenry and investor confidence in the administration of justice”, she added.
