President directs NLA-KGL contract review - KGL Technology welcomes move, commits to more value

President John Dramani Mahama has directed for a comprehensive review of the contract between the National Lottery Authority (NLA) and KGL Technology Limited.

After consultations with the Attorney-General and Minister of Justice, Dr Dominic Ayine, and the Minister of Finance, Dr Cassiel Ato Forson, the President also directed that, where necessary, the contract should be renegotiated to ensure complete protection of the public interest, value for money, and strict compliance with applicable laws, regulations and government policy.

In a letter signed by Secretary to the President, Dr Callistus Mahama, communicating the President’s Directive to the Minister of Finance, the President said the review shall, among others, determine the legal basis, scope, duration, and financial terms of the contract; assess revenue-sharing arrangements, fees, commissions, exclusivity provisions, and any contingent liabilities to the state; and determine compliance with the Constitution, the Public Procurement Act, the National Lottery Act, and any relevant approvals.

The review should also evaluate performance obligations, transparency requirements, data ownership and audit rights, as well as identify any clauses that unduly prejudice the state or constrain regulatory oversight.

“Pending the outcome of this process, all parties are to cooperate fully with the review team and provide unfettered access to contracts, addenda, correspondence, financial records, and operational data as may be required,” the President directed.

It charged the A-G, in collaboration with the Minister of Finance, who is also the Minister responsible for the NLA, to constitute a joint technical team and submit recommendations to the President within a specified timeframe.

“Where the review establishes grounds for renegotiation, the team is to ensure that revised terms secure improved fiscal returns to the state, strengthen governance and accountability, preserve regulatory authority, and align the arrangement with government policy and best international practice,” the directive said.

The directive was copied to the Office of the Vice-President, the Attorney-General and other relevant officers.

KGL ready to cooperate

The Management of KGL Technology Ltd has warmly welcomed the President’s directive, commending him for protecting the continuity of the contract with the interest of the state at heart.

KGL said through the collaboration, NLA and the Ghana Revenue Authority (GRA) earned over GH¢300 million last year alone.

“We sincerely commend the efforts of the Mahama government for protecting as well as creating enabling the environment for private sector and indigenous entrepreneurs to grow as enshrined in Article 36 (Economic Objectives) of the 1992 Constitution,” a statement issued by the External Consultant of the KGL Technology, Razak Kojo Opoku, said.

The statement added that aside from the President’s initiative, the licensing agreements of KGL mandated such reviews after every three years, for which negotiations were required to start six months into next year.

“However, both NLA and KGL agreed to bring forward the review exercise to early this year, 2026, to create enough space for review and negotiations ahead of the implementation in 2027,” it said.

The statement emphasised that KGL was a responsible corporate entity which fully supported the review process being undertaken by the Attorney-General and the Minister of Finance because it would bring finality to the unnecessary attacks against the NLA-KGL deal.

The statement said KGL was a reputable company that boasted high credibility and was therefore not worried for any reason to be scrutinised.

“When accountability is balanced with fairness and respect for facts, it strengthens confidence in our institutions and supports sustainable national development,” the company added.
