Judges files suit against disciplinary procedure

Some of the judges who have been implicated in the corruption scandal at the Judicial Service have filed a suit seeking a declaration that the disciplinary proceedings initiated by the Judicial Council against them was contrary to law and / or due process.

Also they want a declaration that the panel constituted by the Chief Justice to institute disciplinary proceedings against them has no legal basis and therefore null and void.

 

The judges numbering 14 filed the suit on Friday at the Accra High Court.

The plaintiffs are Emmanuel Kofi Sunu, Benjamin Yaw Osei, Kodwo Filson, Seyram Tsatsu Azumah, Isaac Akwantey, Florence Ninepence, Jacob Amponsah, Alfred K. A. Mensah, Albert Zoogah, Isaac Amoah, Michael Gyamfi Boamah, Paul Alhassan, Stephen Asuure and William Baffoe all of Accra.

They are are all judges of the lower courts who have been suspended pending a hearing by a disciplinary committee.

Earlier the judges were said to have scouted for hours in search of a lawyer to help pursue their case before they got Mr John Ndebugre to represent them.

According to Graphic Online’s Court Reporter, Mabel Aku Baneseh, the judges initially approached three lawyers who declined to represent them in court.

The lawyers who spoke on condition of anonymity also declined to mention the names of the judges who approached them.

Meanwhile, some of the judges have been given the chance to view the video.

Suspension

The Judicial Service has suspended 22 judges implicated in the bribery scandal that has rocked the Judiciary.

More than 100 members of staff of the Judicial Service, including judges and magistrates, are being investigated, according to the service.

The judges were captured on video taking money from litigants in what promises to be the biggest scandal ever to hit Ghana’s Judiciary.
