Ofosu Ampofo appeals court's decision to admit witness statement

The National Chairman of the opposition National Democratic Congress (NDC), Mr Samuel Ofosu Ampofo has filed an appeal against the High Court’s decision to admit a witness statement in his ongoing trial.

Mr Ofosu Ampofo and Mr Anthony Kweku Boahen, a Deputy Communications Officer of the party, are standing trial over a leaked tape in which they were allegedly heard inciting violence against the leadership of the Electoral Commission (EC) and the National Peace Council (NPC).

At the start of the trial last Tuesday, a prosecution witness, Benjamin Osei Ampofo Adjei, a journalist with Accra-based Adom FM, had disowned his witness statement that would help the prosecution’s case.

The court, however, admitted the statement into evidence because it bore the witness’s signature.

At Wednesday’s hearing, counsel for Ofosu Ampofo, Mr Tony Lithur, informed the High Court that he had filed an appeal at the Court of Appeal challenging the court’s decision to admit the witness statement as evidence.

The trial will continue on February 11 for Mr Lithur to move an application for stay of proceedings in view of the appeal.
