Stop appointment of new Chief Justice - Justice Torkornoo asks High Court

Former Chief Justice, Justice Gertrude Sackey Torkornoo, has initiated a new action at the High Court, seeking an order to prohibit the appointment of her replacement.

The judicial review application filed at the High Court yesterday, is therefore seeking to stop any process that will lead to the appointment of the acting Chief Justice, Justice Paul Baffoe-Bonnie, as the substantive Chief Justice.

Grounds

Per the application, Justice Torkornoo, who was removed from office by President John Dramani Mahama for misconduct following a recommendation by a constitutional committee, is also seeking an order prohibiting the denial of her salary and entitlement before her removal.

The former Chief Justice is further seeking an order of certiorari quashing the proceedings, deviants an order from the court to quash the proceedings and grounds of the five-member committee that  recommended her removal, as well as the warrant from the President removing her from office.

The former Chief Justice is basing her application on 14 grounds, including unconstitutionality, unfairness, and bias.

This is the second legal action taken by Justice Torkornoo after removal from office.

In the first action, she is asking the High Court to quash her removal as a Justice of the Supreme Court, arguing that the process that led to her removal was only in relation of her position as Chief Justice and not a Justice of the Supreme Court.
