Parliament notifies EC of vacant Kpandai seat

The Parliamentary Service has officially informed the Electoral Commission (EC) of a vacancy in the Kpandai Constituency following a court ruling ordering a re-run of the 2024 parliamentary election in the area.

The notification, dated December 4, 2025, marks the official commencement of the administrative process required to organise a re-run to fill the vacant seat.

The outcome of the re-run is crucial for the representation of the people of Kpandai.

Letter

The letter, addressed to the Chairperson of the EC, Jean Mensa, was signed and issued by the Clerk to Parliament, Ebenezer Ahumah Djietror.

The action was taken "In exercise of the power conferred and the duty imposed on the Clerk to Parliament by Article 112(5), as amended, of the 1992 Constitution of the Republic of Ghana".

The document formally notifies the EC of the vacancy "occasioned by the Order of the High Court, Tamale, for a re-run of the Kpandai parliamentary elections, given on November 24, 2025".

“This notification is a direct consequence of a court order delivered to the Clerk to Parliament as the 4th Respondent in the Suit Number: NR/TL/HC/E13/22/25,” it said.

The Clerk's notification under Article 112(5) of the 1992 Constitution is a mandatory step that legally empowers the EC to begin preparations for the re-run.

Article 112(5) stipulates that when a vacancy occurs in Parliament, the Clerk must notify the EC, and an election must be held within 90 days after the vacancy occurs, unless the vacancy occurs within three months before the dissolution of Parliament.

Given the current date of the notification (December 4, 2025), the EC is now obligated to organise the rerun by early March 2026.

The EC is expected to announce the timetable, including nomination deadlines and the exact date for the re-run election in the coming weeks.

Recall

The Tamale High Court last Monday annulled the 2024 parliamentary election results for the Kpandai Constituency in the Northern Region.

The court, presided over by Justice Emmanuel Brew Plange, held that the election was flawed with widespread irregularities and, therefore, ordered a rerun of the election within 30 days.

The seat is currently occupied by the New Patriotic Party (NPP) Member of Parliament (MP), Matthew Nyindam.

Petition

The 2024 National Democratic Congress (NDC) parliamentary candidate for Kpandai, Daniel Nsala Wakpal, on December 23, 2024, filed a petition at the court challenging the Electoral Commission’s (EC) declaration of Mr Nyindam as the MP-elect for the constituency.

He alleged that the results of the parliamentary elections, as declared by the EC, were invalid due to some irregularities and inconsistencies contained in some of the pink sheets.

Non-compliance

After examining the evidence, the court agreed with the petitioner, ruling that the level of non-compliance materially affected the outcome of the poll.

It subsequently ordered the EC to organise a new parliamentary election in the constituency to determine the rightful winner.

Following the ruling, lawyers for the defendant have filed for a stay of execution pending the determination of an appeal.

Results

The annulled results had placed Mr Nyindam in the lead with 27,947 votes, representing 53.47 per cent, while Mr Wakpal had 24,213 votes, representing 46.33 per cent.

However, the parliamentary candidate for All People Congress (APC), Donkor Eric Nipani, secured only 104 votes.

The election in the constituency was characterised by violence.

At the collation centre, election materials such as ballots and Biometric Verification Devices were reportedly vandalised during the chaos.

It took the timely intervention of security personnel to restore calm.
