"Shocked" Justice Dery petitions CJ over dismissal of contempt case against Anas, others

One of the High Court judges implicated in the judicial corruption scandal, Justice Paul Uuter Dery, has petitioned the Chief Justice on the dismissal of the contempt charges he brought against journalist Anas and four others.

In the petition, Justice Dery asserted that the ruling given by Court of Appeal judge, Justice Gertrude Torkornoo, contravened his right to be heard.

Justice Dery brought the suit on September 18, 2015 citing investigative journalist Anas Aremeyaw Anas, two editors at the New Crusading Guide newspaper, Starr FM CEO, Kwabena Anokey Adisi, and Sulemana Braimah of the media Foundation for West Africa, for contempt.

An Accra High Court, however, dismissed the application on Tuesday, holding that since Justice Dery had earlier withdrawn an application for interlocutory injunction to restrain Anas from showing the video, it was legally untenable for the court to commit the five for contempt.

The decision did not sit well with Justice Dery, prompting him to petition Madam Georgina Wood.

“This came as an absolute shock to us since on the motion paper, the said case is scheduled to be heard on the 12th of October 2015,” Nii Kpakpo Samoa Addo, lawyer for Justice Dery, stated in the petition.

Justice Dery is one of the judges indicted in the Anas video for allegedly taking bribes to subvert justice.

Apart from suing Anas and the aforementioned four others, he also filed a suit against the Managing Director of Global Cinemas, Mr Ernest Oppong.

Justice Dery had earlier filed a contempt application against the Accra International Conference Centre.
