Supreme Court dismisses ‘God created man’ suit

The Supreme Court has dismissed a suit which was urging it to declare that God created man.

The Mirror on Saturday, March 20, this year, published the story about the suit before the court.

The plaintiff, Mr Johnson Anane, an Assistant Lecturer at the Sunyani Technical University, went to the apex court with a case that man was created by God and not through the evolution theory as stated by scientists.

He also wanted the highest court of the land to declare that days, nights and years were created by God and did not occur as a result of the movement of the earth, which was the position of science.

Dismissal
In a unanimous decision, a seven-member panel of the apex court threw out the case on the basis that the plaintiff failed to properly invoke its jurisdiction.

According to the apex court, the case did not fall under any of its jurisdictions as it was not one seeking interpretation or enforcement, neither was it invoking its supervisory or appellate jurisdiction.

However, the dismissal has not perturbed Mr Anane as he has filed a review application challenging the decision of the highest court of the land.

The Supreme Court is expected to hear the review on May 18, this year.

Suit
Mr Anane went to the Supreme Court with a case to challenge the evolution theory which explains that man was not created by God but evolved from apes.

He also raised issues with the position of science that the earth was a planet in the solar system and that the earth’s movement around the sun resulted in days, nights, years and seasons.

According to him, days, nights, years and seasons were created by God and did not come about as a result of any movement of the earth.

The plaintiff argues that the evolution theory and the solar system theory were against the Bible which said God created the earth.

“The implications of the theories are that the creative work of God as stated in Genesis has been cancelled, denied or nullified,” he stated in his writ.

Ban
Apart from urging the highest court of the land to uphold his claims, Sir Anane also wanted the court to ban the study of the evolution theory and the solar system in the country.

“These theories are taught in schools (primary, JHS and SHS) and need to be banned or abolished,” he said.

The suit was against the director-general of the Ghana Education Service, the president of the Ghana Science Association of Ghana and the Attorney-General’s Department.
