Two jailed 46 months for indecent assault

Two persons, including a 35-year-old military man  stationed at Burma Camp, has been sentenced to a total of 46 months imprisonment with hard labour by the Accra Circuit Court for engaging in two separate indecent assaults.

In the first case, Corporal Daniel Yeboah, the convict, is said to have lured a six- year-old child into his room and inserted his fingers into her private part.

He pleaded not guilty to the offence of indecent assault but the court, presided over by Ms Sedinam Agbemava, found him guilty of the offence after a full trial and convicted him accordingly.

In his judgement, the trial judge said a medical report that was issued on the victim confirmed that “the convict sexually violated the victim by inserting his fingers into the private part”.

She held that even at a tender age, the victim could still remember what the convict did to her and narrated the incidence to the court 

According to the court, even though the convict said he was mentally imbalanced and had visited the psychiatric hospital earlier, the forms he presented as evidence could not be taken because it was blank with just his name.

The judge noted that “the convict is being untruthful because no medical report has been able to confirm that he is not in his right frame of mind and his own witness testified that he is mentally sound”.

Prosecution Chief Inspector of Police, Mr A.A.Annor, told the court that the complainant was the father of the victim and a military officer who live in the same block with Corporal Yeboah at Burma Camp.

He said on September 19, 2012, at about 4p.m., the victim had returned from school and was playing when the convict called her to his room.

He said the convict offered the victim toffee and asked her to unzip her dress but she refused.

Corporal Yeboah, he said, forcibly removed the victim’s pant and inserted his fingers into her private part which made the victim to shout for help.

Her mother quickly rushed to the convict’s door and upon knocking severally, the convict opened the door, prosecution said.

Mr Annor said the victim informed the mother about her ordeal and she later lodged a complaint at DOVVSU/AR where a police medical form that was issued confirmed the act.

In the second case, Godwin Agorbia was also sentenced to 10 months imprisonment with hard labour for fondling the breast of a 27-year-old married woman.

He pleaded not guilty to the offence of indecent assault but was found guilty by the court after a full trial.

A bench warrant had been issued for the arrest of his accomplice, Wisdom Bassey, who witnessed the commission of the crime
