EC sets Dec. 30 for Kpandai parliamentary election rerun

The Electoral Commission (EC) has set Tuesday, December 30, this year, for the rerun of the parliamentary election in the Kpandai Constituency in the Northern Region.

This follows the Tamale High Court's ruling on Monday, November 24, 2025, ordering a rerun of the “Kpandai Constituency Parliamentary Election within 30 days”.

Upon receipt of a letter from the Clerk to Parliament on Tuesday, December 9, this year, notifying the EC of the occurrence of a vacancy in the membership of Parliament, the EC fixed the date.

A statement issued in Accra yesterday, signed by the Deputy Director of Research, Monitoring and Evaluation Department at the EC, Fred Tetteh, said the rerun of the Kpandai Constituency parliamentary election would be conducted for only the three candidates who contested the 2024 parliamentary election in the constituency.

They are Matthew Nyindam of the New Patriotic Party (NPP), Daniel Nsala Wakpal of the National Democratic Congress (NDC) and Donkor Eric Nipani of the All People’s Congress (APC).

Parliament’s notification

The Parliamentary Service informed the EC of a vacancy in the Kpandai Constituency following a court ruling ordering a rerun of the 2024 parliamentary elections in the area.

The notification, dated December 4, 2025, marked the official commencement of the administrative process required to organise a rerun to fill the vacant seat.

The letter, addressed to the Chairperson of the EC, Jean Mensa, was signed and issued by the Clerk to Parliament, Ebenezer Ahumah Djietror.

The action was taken "In exercise of the power conferred and the duty imposed on the Clerk to Parliament by Article 112(5), as amended, of the 1992 Constitution of the Republic of Ghana".

The document formally notifies the EC of the vacancy "occasioned by the Order of the High Court, Tamale, for a rerun of the Kpandai parliamentary election, given on November 24, 2025".

“This notification is a direct consequence of a court order delivered to the Clerk to Parliament as the 4th Respondent in the Suit Number: NR/TL/HC/E13/22/25,” it said.

The Clerk's notification under Article 112(5) of the 1992 Constitution is a mandatory step that legally empowers the EC to begin preparations for the rerun.

Article 112(5) stipulates that when a vacancy occurs in Parliament, the Clerk must notify the EC, and an election must be held within 90 days after the vacancy occurs, unless the vacancy occurs within three months before the dissolution of Parliament.

Recall

The Tamale High Court, presided over by Justice Emmanuel Brew Plange, held that the election was flawed with widespread irregularities and, therefore, ordered a rerun of the election within 30 days.

The seat was currently occupied by the NPP Member of Parliament (MP), Matthew Nyindam.

Petition

The 2024 (NDC) parliamentary candidate for Kpandai, Daniel Nsala Wakpal, on December 23, 2024, filed a petition at the court challenging the EC’s declaration of Mr Nyindam as the MP-elect for the constituency.

He prayed the court that the results of the parliamentary elections, as declared by the EC, were invalid due to some irregularities and inconsistencies contained in some of the pink sheets.

The election in the constituency was characterised by violence.

At the collation centre, election materials such as ballots and Biometric Verification Devices were reportedly vandalised during the chaos. 

It took the timely intervention of security personnel to restore calm.
