Supreme Court throws out EC's request

The Supreme Court in a unanimous decision has refused the Electoral Commission's request to be allowed to file affividats after the petitioners have closed their case.
The EC had urged the Supreme Court to vary its April 2, 2013 order which directed respondents in the petition to file their written affidavits within five days from the service of petitioners’ affidavits on them.
The Supreme Court sat Wednesday to consider the request from the Electoral Commission and threw out the motion.
The
court said the motion filed by the second respondent was without merit
and ordered that they respond to the affidavits by the petitioners.
