Surveyor defrauds businessman

A surveyor who defrauded a businessman by false pretence has appeared before the Odumase-Krobo Circuit Court, presided over by Mr Frank Yao Gbeddy.

Isaiah Abia Kwasi, 39, who defrauded Jacob Maduku Rexford a sum of GH¢47,000 has been granted GH¢50,000 bail with a surety to be justified.`

Kwasi however fulfilled the bail bond and the case was adjourned to May 31, 2016 for hearing. 

The facts of the case as presented by ASP Richmond Akwasi Yeboah were that Rexford, the complainant and Kwasi resided at Kodjonya, a suburb of Odumase-Krobo.

The prosecutor said in January, 2015, Rexford bought a parcel of land from a certain man at Trom, a suburb of Somanya and Kwasi, who was present during the transaction with the intention of defrauding, told Rexford he had five acres of land at Lakpahwe at the outskirts of Odumase-Krobo for sale.

According to the prosecutor, Kwasi convinced Rexford and took him to the land and priced it at GH¢18,000. Kwasi paid for it in the presence of a witness and Kwasi issued a receipt for it. 

The prosecutor said on June 22, 2015, Kwasi again went to Rexford and offered for sale another five acres of land, plus two plots attached to the one he had already sold to him.

According to Mr Yeboah, Rexford expressed interest and the price was settled at GH¢20,000. Kwasi paid for it some few days later in the presence of a witness and once again a receipt was issued. 

The prosecutor said Kwasi further demanded GH¢5,000 processing fee for documentation of the lands and Rexford gave him the money.

Mr Yeboah said after all the payments Rexford went ahead to cultivate the lands and planted 400 mango seedlings valued at GH¢4,000.

According to the prosecutor, Rexford later visited the farm one day and to his surprise detected that all the mango seedlings were destroyed.

Mr Yeboah said investigations by Rexford showed that the lands were not for Kwasi and so confronted Kwasi and asked for a refund of his money. 

He said Kwasi agreed to refund the money at the end of March, 2016, but failed to do so. Rexford, therefore, reported the case and Kwasi was arrested. 

In his caution statement, Kwasi admitted that he collected GH¢37,000 from Rexford and not GH¢47,000 as Rexford alleged.
