Facts
Prosecuting, Assistant Commissioner of Police (ACP), Mr Moses Atibilla, told the court that the complainant was a pharmacist with the Pharmacy Council in Accra who doubled as a production officer for Duba Pharma Company Limited, a pharmaceutical company at Atonsu in Kumasi.

Mr Atibilla said Corporal Aboagye and Lance Corporal Kyeremeh were policemen stationed at the Criminal Investigations Department (CID) headquarters in Accra and the Lapaz Police Post, respectively, while Danso and Dadzie were a driver and a businessman, respectively.

He said on July 7, 2014, the complainant procured an Ephedrine hydrochloride substance worth $60,000, which he was going to use for the production of Nasal drops, kept it at the back seat of his private car and drove to North Kaneshie to visit a friend.

He said while waiting at a drinking spot for the arrival of his friend, Danso and Dadzie alerted  Corporal Aboagye and Lance Corporal Kyeremeh, who were armed with pistols, to the fact that the complainant was carrying the said substance.

He said the two policemen stormed the drinking spot and confronted the complainant about the content of the bag in his car.

After the complainant had disclosed the content, the prosecutor said Corporal Aboagye handcuffed him, claiming the substance was suspected to be cocaine and ordered him to surrender it.

Mr Atibilla said the policemen subsequently arrested the complainant, put him in their car and drove him to the Achimota School Police Station.

The prosecutor said at the police station, the two policemen left the complainant to his fate and sped off with the substance.
He said Danso subsequently met the policemen at Tesano and took possession of the substance they claimed to be cocaine.

Mr Atibilla said Danso kept the substance in his room and later that day the two policemen went to hand over the substance to Dadzie at Dome for sale.

He said the complainant reported the matter to the police and investigations were conducted.

On July 18, 2014, the complainant, in the course of his rounds, spotted Lance Corporal Kyeremeh at his duty post at Lapaz in Accra, he said.
He immediately informed the Tesano Police and Lance Corporal Kyeremeh was arrested.

During interrogation, Lance Corporal Kyeremeh assisted the police to arrest Corporal Aboagye.

Mr Atibilla said the complainant identified Corporal Aboagye during an identification parade and investigations later led to the arrest of Danso and Dadzie.
