Tenant refuses to move out

A trader, Abiba Sulemana, is before an Accra Magistrates’ Court for refusing to move out of a house belonging to a businessman, Ayittey Osman.

Abiba was charged with unlawful entry and trespassing when she appeared before the court, presided over by Mr James Kojo Botah. 

She pleaded not guilty on both counts. 

Abiba was granted a bail in the sum of GH¢ 500 and was also directed to present one surety.

Abiba, who stays with her husband and three children in Osman’s house, admitted she was aware of the eviction notice.

She said Osman had found a place for her to move to, but it was too far, hence her reluctance to move out of her current place of abode.

Mr Botah referred both parties to an ADR but Abiba requested the court to grant her some time to re-locate.

Presenting the facts of the case at the Adjabeng Court 2, Chief Inspector Yeboah said Osman had on May 4, 2016, obtained an order from the High Court in Accra for the tenants including Abiba to vacate the said building.

Inspector Yeboah said all the occupants complied except Abiba, who claimed she had nowhere to go. 

On June 6, 2016, Osman enforced an ejection order on Abiba who had unlawfully re-occupied the room.

According to prosecution, on June 7, 2016, Abiba was arrested by  the police  and during interrogation, she stated that one Evans who was also an occupant of the house was the one who allocated  the  room to her to live in with her three children, but  had not paid the rent since 2015.
