Governor, 2 other Bank of Ghana officials cited for contempt

The Governor of the Bank of Ghana, Dr. Abdul-Nashiru Issahaku and two other officials of the Bank have been cited in a contempt of court case for failing to execute a court order.

The others two are Messrs Anthony Ayi Ajavon (Acting Head of Legal), and Saviour Kudze, a schedule officer of the Legal Department of the Bank.

The bank has ‘willfully’ failed to execute a garnishee order imposed on it by the High Court, Commercial Division, according to Mr Eli Agbemava, counsel for Eland International Thailand Company Ltd, which successfully litigated against the National Investment Bank and Prestea Sankofa Gold Ltd.

Having so failed to comply with the “clear and unambiguous valid court order”, counsel says the court must punish them since they had no option than to comply with the orders, issued first as a garnishee nisi on September 9, 2016, and later as a garnishee absolute on February 7, 2017.

Eland had sued the NIB following disagreements over a 400,000 dollar loan it guaranteed for Prestea Sankofa, following which the court ruled on August 11, 2016 that the NIB pay Eland International the total of 511,000 US dollars.

The contempt case is to be heard on Friday, February 24.
