Mason receives 12 months for unlawful entry

For three counts of unlawful entry, being on premises for unlawful purposes and stealing, the Odumase Krobo Circuit, presided over by Mr Frank Gbeddy, has sentenced a 26-year-old maison to four months in prison for each count to run consecutively.

The convict, Henry Ayitah aka Horsey pleaded guilty.

The facts of the case as presented by Chief Inspector Emmanuel Tetteh, the prosecutor were that, the complainant, Joana Amatey, 31-year-old student resided at Natriku, a suburb of Akuse as well as the accused.

C/Inspector Tetteh said, Amatey’s late grand-father, owned a house at Natriku where Amartey and one Narh, who was a witness in the case lived.

According to the prosecutor, for some time now, thieves had been stealing from the house.He said since the beginning of this year, tractor parts, car battery and a printer had been stolen from the house.

C/Inspector Tetteh said on July 28, 2015, at about 8:30 am, Amatey was in her room with the main gate to the house well locked when she saw the accused, Ayitah walking on the compound. 

Amartey suspected the accused and shouted at him in query as to how he managed to get into the house since the gate was locked. The accused, however, also answered that he was looking for one Narh, the caretaker of the house.

When the complainant again found out from the Ayitah how he managed to get into the house, he said he jumped the fenced wall. As the complainant walked towards the accused, Ayitah again jumped the fence wall and escaped.

The complainant then walked to where the accused was standing and found one bucket of Azar Tex Emulsion paint.

She took the bucket of paint and made the report to the Akuse Police.

The persecutor said, on August 1, 2015, the accused was spotted at the Akuse Police Station and was arrested and detained for investigation.

He said the complainant later came and identified the accused person as the one who jumped the wall.

The accused person in his cautioned statement admitted the offense and told the police that he jumped the fence wall to look for mangoes.  He also admitted that he stole the bucket of paint and wanted to send it away but the intervention of the complainant prevented him from carrying it away.

The court ordered the police to return the paint to the complainant.
