GBA urges adherence to rule of law in Chief Justice Torkornoo's suspension

The Ghana Bar Association (GBA) has expressed concern over the procedure that led to the suspension of Chief Justice Gertrude Sackey Torkornoo by President John Mahama on April 23, 2025.

In a statement issued on April 24, the GBA acknowledged the constitutional provisions for removing the Chief Justice from office as outlined in Article 146 (6) to (10) of the 1992 Constitution. 

While recognising that the matter was currently sub judice, the association expressed hope and belief that all parties involved would be guided by the time-tested principles of the rule of law and ensure that due process is followed in both letter and spirit.

The association further noted the importance of Article 296 of the Constitution, which governs the exercise of discretionary powers. It urged that every individual playing even the smallest role in the process act in a way that upholds the independence and integrity of the Judiciary.

“Justice emanates from the good people of Ghana and is administered by the Judiciary, led by the Chief Justice,” the statement read.

Reaffirming its commitment to justice, the GBA emphasised its duty to defend, strengthen, and enhance public confidence in the justice delivery system of Ghana.

“The GBA shall remain the concience of the society, the voice of the voiceless and act to safeguard the Rule of Law and uphold the Constitution of the Republic which embodies the wishes and aspirations of the people of Ghana,” the association said.
