NLC directs CLOGSAG to call off strike

The National Labour Commission (NLC) has asked the Civil and Local Government Staff Association (CLOGSAG) to call off its strike with immediate effect.

A statement signed by the Executive Secretary of the NLC, Mr Charles Bawaduah, said the strike was illegal and contravened Section 159 of the Labour Act 2003 (Act 652).

“Consequently, the NLC, in exercise of the authority conferred on it by section 139 (1) (d) of Act 651, hereby notifies the members of CLOGSAG that the strike currently being embarked upon is illegal as same is in gross violation of the Labour Act 2003 (Act 651),” the statement added.

It explained that the NLC invited CLOGSAG and the Fair Wages and Salaries Commission (FWSC) to appear before it on August 3, 2016 to resolve the dispute over the payment of interim market premium that had occasioned a strike by CLOGSAG.

It said officials of the FWSC appeared before the NLC but the representatives of CLOGSAG tendered in a letter to the effect that they would not be able to be part of the meeting to resolve the issue.

 Portions of the letter that CLOGSAG sent to the NLC stating its inability to be represented at the meeting read, “We acknowledge receipt of your letter dated July 27, 2016, inviting the association to appear before the NLC on August 3, 2016. Unfortunately, our solicitor and lawyer has travelled out of Accra and therefore has humbly requested a rescheduling of the hearing to August 10, 2016.”

The NLC, according to the statement, considered the reasons CLOGSAG gave for its inability to appear before it as untenable for which reason the directive was given for the strike to be called off.

The two embattled bodies have, however, been asked to appear before the NLC on August 10, 2016, to present their issues for determination by the NLC.
